<p>El presente artículo deriva del trabajo de investigación  del mismo autor (Gonzales Linares, 2014), que realiza una crítica valorativa sobre las resoluciones de primera y segunda instancia emitidas por el Indecopi  entre los años 2006 y 2013. Respecto de denuncias de parte y procedimientos de oficio derivados de casos de discriminación en la prestación de servicios educativos, por motivo de discapacidad, religión, orientación sexual y condiciones económicas. Ello a partir de criterios valorativos preestablecidos y principalmente vinculados a la actuación de la prueba y la imposición de la sanción. <br /><br />Desarrollado el análisis, se obtuvo como resultado que el Indecopi no maneja adecuadamente los recursos procedimentales que le asisten, ni cumple con el requisito de motivar sus resoluciones. El propósito del presente artículo es ofrecer una perspectiva práctico – realista que sirva de instrumento para nutrir futuros debates sobre el tema.<br /><br />This paper is based on research that conducted an evaluative review of the resolutions of first and second instance of Indecopi, issued regarding complaints and ex officio procedures as a result of discrimination in the provision of educational services based on disability, religion, sexual orientation and economic conditions. Two criteria, the evidence presented and the sanction imposed were used.</p><p><br />As a result, the research found that Indecopi mishandle their procedural resources and did not meet the requirement to base their decisions. The purpose of this article is to provide a practical and realistic view of the subject and to contribute to future discussions on the subject.</p>

Motivation/Background: The formation of a lesbian mindset does not happen immediately. This study aims to explore the process of family roles experienced by research subjects who have a lesbian sexual orientation even though it is not accordance with their religion. Method: The research method used was a qualitative research of phenomenology in two subjects who had lived lesbian sexual orientation for more than 2 years with different backgrounds. Interpretative Phenomenological Analysis was conducted to analyze the role of the family as a model, how the subject perceives the stimulus, direct or indirect environmental contributions, and how close family experiences form a lesbian mindset about the subject. Results: The results of this study indicate the subject "I" had a model of his father's behavior and reinforces the general perception of his mother that men had bad behavior. The social Environment made the subject felt ostracized and entered the domain of the lesbian community who can accept the subject with the circumstances as she was without much demand. A female friend in this environment became modes and informants experienced being lesbian. Meanwhile, "R" was growing psychologically with a style of parenting that is too spoiled by her mother and got a model and informants experienced from her older sister. Conclusions: Both subjects get different experiences in the process of forming a lesbian mindset. From a neurocognitive social perspective, the formation of a lesbian mindset is very complex. Neurocognitive response of the experience of getting too many rough touches or too long getting a hug of comfort, both can trigger perceptions that supported by the environment will form a lesbian mindset.

Abstract Aging is the subject of various studies by the scientific community and monitoring by responsible institutions. The intensity of aging and the proportion of age groups among various communities differ due to different socio-economic conditions and characteristics. This article researches the impact of the war in Croatia 1991–1995 and postwar living conditions on the divergence of population aging in the ethnically heterogeneous Banija region. The first postwar census in 2001 recorded a population decline of 44.9% compared to the 1991 census. We analyze the effects of the war on changes in ethnic and age structure, as well as their interrelations. The quantitative and qualitative magnitude of these demographic changes in the inter-census period had a decisive influence on the correlation of age and ethnic structure. The article examines whether the relative share of Serbs or Croats in the total population of a settlement affects the average age of the settlement. The results confirmed that the Serbs are older than the Croats, and are in the phase of the most advanced demographic age. These changes raise the question of the demographic future and the biological viability of the Serbs, who were the majority in the region before the war.

Abstract The extent to which members of the clergy are considered ‘employees’ for the purposes of secular employment and equality legislation has been the subject of much discussion, but essentially remains a fact sensitive question. The Equality Act 2010 (‘the 2010 Act’) seeks to prevent discrimination on the basis of nine ‘protected characteristics’. While recognizing that the application of the 2010 Act to the variety of clergy offices is ‘not straightforward’, the Church of England (‘the Church’) has opined that an equitable approach to clergy appointments is to proceed as if they were subject to the provisions of the 2010 Act. What follows is in`tended to be a thorough review of the eligibility criteria for clergy appointment in the Church to assess their compatibility with the requirements of the 2010 Act. In addition, particular consideration will be given to Schedule 9(2) to the 2010 Act which makes specific provision relating to religious requirements concerning the protected characteristics of sex, sexual orientation, and marriage and civil partnership. In short, where the employment is for the purposes of an organized religion, such as the Church, requirements which relate to these protected characteristics will not constitute discrimination where they engage the ‘compliance or non-conflict principle’. What these principles mean and how they might operate in practice is discussed below, taking into account the likely canonical and theological justifications for discriminating against certain individuals. Whether the law strikes the right balance between, on the one hand protecting clergy and, on the other, providing the Church with the autonomy to act in accordance with its established doctrine, will be explored in the final analysis.

At one point in “The Soul of Man Under Socialism,” an essay that deals directly neither with the soul nor with socialism, Oscar Wilde quotes obliquely from Ralph Waldo Emerson:[People] go through their lives in a sort of coarse comfort, like petted animals, without ever realising that they are probably thinking other people's thoughts, living by other people's standards, wearing practically what one may call other people's second-hand clothes, and never being themselves for a single moment. “He who would be free,” says a fine thinker, “must not conform.” And authority, by bribing people to conform, produces a very gross kind of over-fed barbarism among us. (267)That Wilde was attracted to Emersonian nonconformity is not surprising, and the similarities between the two writers are striking. But my reason for citing Wilde, the ur-homosexual and model of iconoclasm, is that I want to show that Emerson is as innovative a thinker as Wilde, and that indeed on the subject of individualism and personal relationships he is far more so. In fact, Wilde can be seen as taking certain ideas of his teacher Walter Pater and giving them an Emersonian and American cast, expressing more openly Pater's cloistered Oxford radicalism. The “Socialism” essay in particular develops strong connections among aestheticism, individualism, and sociopolitical dissent, revealing a strong desire for alternatives to late-19th-century British society. And of course in the case of Pater as well as Wilde, the need for individualism and the quest for new forms of social connection have obvious links to both writers' alternative sexual orientation. What makes Emerson more radical, more, if you will, “queer,” is precisely that he is not arguing for any sexual orientation, but is attempting — many years before the Oxford aesthetes — to create a free space for alternative forms of gender and new forms of personal relationships to develop. Emerson values dis-orientation more than any orientation.

Exemptions for religious groups from generally applicable laws are by no means unusual, especially in the field of discrimination law. However, exemptions from laws prohibiting discrimination on grounds of sexual orientation have proved particularly controversial. The legality of exemptions in regulations prohibiting discrimination on grounds of sexual orientation in the employment sphere has been the subject of judicial review and the scope of those exemptions has also been judicially examined. The extension to prohibit discrimination on grounds of sexual orientation in the provision of goods and services has proved controversial, and case law on the extent of the religious exemption included in the British regulations is awaited. In the meantime, a recent judicial review of the corresponding Northern Ireland regulations, which were enacted prior to the British regulations, may be illuminating.

Abstract This paper explores the subject of sustainable governance in Nunavut and analyses the efficacy of the Nunavut Human Rights Act and the Human Rights Tribunal. It argues that sustainable governance in Nunavut is linked with the issue of the efficacy of the human rights regime in the territory and vice-versa. The paper looks at how socio-economic conditions, self-reliable development of Nunavut and performance of its governmental institutions are vital for the prospects of sustainable governance and human rights in this Arctic jurisdiction populated by a majority of indigenous Inuit.

This article is the result of research findings undertaken in Limpopo Province on the subject of witchcraft beliefs. It is a narration of two villages whose residents were accused of witchcraft and had to be moved to other villages for their safety. Socio-economic conditions responsible for the communities to accuse their members of witchcraft are analysed. In the last part of the paper I draw on some classical theoretical approaches such as projection, scapegoating and materialism theories. In conclusion three statements are considered: 1) witchcraft is something real in human experience; 2) witchcraft is an imaginary crime; 3) an explanation of witchcraft accusations seen through the lens of social theories on society.

ABSTRACTBullying is a current problem that occurs in education and has recently become extremely important for society. However, homophobic bullying has not been given the importance it should have. This one, refers to the harassment that is suffered by sexual orientation or condition, sometimes being the reason for such negative behaviors. Therefore, with this research work, by quantitative study, it has been analyzed the knowledge that primary education teachers have on this matter.
