ResumoEste artigo tem como objetivo indicar alguns apontamentos acerca dos direitos dos trabalhadores sob a perspectiva dos direitos sociais, expressando-secomo problema as discussões sobre o exercício da cidadania e a efetivação da dignidade da pessoa humana. Dentro desta perspectiva temática, através do método hipotético-dedutivo, aborda-se sobre a positivação dos direitos dos trabalhadores na ordem constitucional representar um novo paradigma valorativo com relação ao valor social do trabalho. Nesse sentido, a livre iniciativa e o primado da dignidade da pessoa humana forneceram um arcabouço normativo cuja interpretação pelos operadores do direito permite concretizar os direitos sociais. Essa concepção pode ser definida como sendo um conjunto mínimo de direitos que cada ser humano possui, baseado na sua dignidade humana. Daí decorre a importância dos direitos humanos, dos direitos sociais e, em especial, dos direitos dos trabalhadores. AbstractThis article aims to indicate some notes about the rights of workers from the perspective of social rights, expressing as a problem the discussions about the exercise of citizenship and the realization of the dignity of the human person. Within this thematic perspective, through the hypothetical-deductive method, it is approached about the positivation of workers' rights in the constitutional order to represent a new value paradigm with respect to the social value of work. In this sense, free enterprise and the primacy of the dignity of the human person have provided a normative framework whose interpretation by lawmakers allows the realization of social rights. This conception can be defined as a minimum setof rights that each human being possesses, based on their human dignity. Hence the importance of human rights, social rights and, in particular, workers' rights.

RESUMOPauta-se por reflexões circundantes a determinados princípios e valores que alicerçam ordenamentos pretensamente promovedores da pessoa humana como eixo vital de proteção e fomento, em consonância com a efetivação de direitos, em especial aqueles primordiais ao núcleo medular da personalidade e dignidade humana, na contraposição de aspectos e influências que derruem a legitimidade social de certas escolhas políticas eivadas de intenções particulares antagônicas ao melhor interesse público. Visa promover certa conscientização pela necessidade de (re)consideração de determinadas atuações político-sociais, notadamente no âmbito legislativo, para que sejam debelados obstáculos os quais se opõem ao reconhecimento e à real participação de cada pessoa na formação de elementos garantidores do livre desenvolvimento da personalidade e de uma vivência digna a todos. It aims to promote a certain awareness of the need to (re) consider certain political and social actions, especially in the legislative sphere, so that obstacles are overcome, which oppose the recognition and real participation of each person in the formation of elements guaranteeing the free development of personality and a worthy experience to all. In the quest to understand the meaning of existence, the human being is torn between many choices, exposed to individualism of all forms, especially atheistic perspectives. John Paul II’s personalism in the light of Thomas Aquinas’ personalistic notion of mercy suggests an alternative of meaningful living, co-existence, and holistic transcendence. John Paul’s search for the basis on which individual and social rights may grow and enhance human dignity demonstrate the ontological human worth. Following Aquinas’ model, John Paul shows that human dignity takes precedence over all options and needs preservation. Similarly, Aquinas’ classification of the human person as “rational subsistent” portrays this dignity in “effective mercy” that allows one to thrive in all kinds of existential vicissitudes. This essay explores John Paul’s personalist notion of mercy reflecting Aquinas’ model in the contemporary milieu in view of holistic existence.

<p>The culprit is one of the fixed parties in penal judgments and because he is to be stood before the social rights with the support of the prosecutor he enjoys a vulnerable judicial standpoint. The person being charged with a crime or an offence faces the judicial system in the preliminary investigation stage, in other words, pretrial stage. In this stage the culprit, due to the fact that has not been convicted to any crime, he has to undergo interrogation and investigation based on the acquittal principle and preservation of the human prestige and credit. Interrogating the culprit is the main axiom of the pretrial period and it is possible that the culprits be exposed to torture and inhumane behaviors as a result of their rights being ignored and their human dignity being refused by the interrogating bodies. Therefore, the accused person should be enjoying the rights and liberties under the shade of the fair judgment. On the other hand, fair judgment is not intended solely for safeguarding the accused person’s defense rights, rather a just proceeding in its exact meaning is seeking to serve the preservation and supporting the rights and the liberties of all of the individuals who somehow share the legal procedure process. Observing a fair procedure should not be taken as to mean leniency for any single one person, rather observing such principles in the proceedings causes the humanity aspect of the parties not to be underestimated and justice and fairness can be implemented and served regarding their rights.</p>In the present article because it is carried out in humanities realm we have tried to make use of an analytical-descriptive method through the use of the international charter of human rights and requirements and the constitutional laws in Iran and this is while the accused individual rights in the pretrial period has also been enumerated and elucidated on and then we deal with the survey of the Iran’s judicial system and the international charter of human rights regarding the methods of keeping a hold onto such rules and regulations and consequently we will figure that in both of the described systems it has been frequently emphasized on observing the accused person’s rights in the majority of the cases in this period and there has been criminal enforcement mandates for it.

Este trabalho constitui um ensaio temático que resta dividido em três atos, no primeiro são abordados os direitos humanos e a dignidade da pessoa humana enquanto valor e princípio fundamental; no segundo a dignidade da pessoa humana na ordem constitucional e no terceiro e último, a dignidade humana e a interpretação judicial dos direitos humanos. Tendo como objetivo nuclear, possibilitar uma visão reflexiva sobre a dignidade da pessoa humana. Como pano de fundo deste trabalho, real motivação do estado da arte e das indagações suscitadas ao logo do texto, está a instigação de reflexões, através de uma análise filosófico-histórica mais aprofundada do conceito de dignidade da pessoa humana enquanto essência da humanidade. Razão pela qual, este trabalho visa contribuir com a construção do conhecimento em relação à dignidade da pessoa humana.   This paper is a thematic essay divided into three acts. The first one deals with human rights and the dignity of the human person as a fundamental value and principle; the second one with human dignity in the constitutional order; and the third and last one with human dignity and the judicial interpretation of human rights. The nuclear objective is to enable a reflective view on the dignity of the human person. The background of this work, the real motivation of the state of the art and the questions raised throughout the text, is the instigation of reflection, through a deeper philosophical-historical analysis of the concept of dignity of the human person as the essence of humanity. For this reason, this paper aims to contribute to the construction of knowledge regarding the dignity of the human person.

Toda disciplina de tipo humanista o de carácter social asume como uno de sus presupuestos fundamentales una noción de lo que es el ser humano. Llevar a cabo una reflexión de tipo filosófico sobre las nociones de hombre, persona y dignidad se vuelve imprescindible para aclarar elementos antropológicos que son fundamentos teóricos de las ciencias humanas y sociales. La palabra “hombre” admite significados que en parte coinciden y en parte difieren con la noción de persona. La expresión “persona humana” no es siempre una redundancia. Siguiendo el pensamiento de Santo Tomás de Aquino, que distingue entre las nociones de hombre y persona, la subsistencia de la persona humana se vuelve fundamento de la dignidad humana y fuente de los derechos humanos.All humanist or social discipline assumes as one of its fundamental principles an idea of what human being is. Accomplishing a philosophical reflection about the man notions, person and dignity become essential to clarify antropological elements which are theorical fundaments of human and social sciences. The Word man accepts meanings that are partly the same and partly different with the concept of human person, in some way, is not totally a redundancy. Following Saint Thomas Aquinas´s thought who distinguishes between the notions of man and person, it is noted that the subsistency of the human person turns into the human dignity basis and source of all human rights.

La Dichiarazione universale dei Diritti dell’uomo del 1948 dell’ ONU ha posto in termini politici, e non soltanto filosofici o religiosi, al centro stesso della logica della cittadinanza l’affermazione della dignità umana e della libertà come qualità innate e non acquisite. Affermare che tutti gli uomini nascono liberi ed eguali in dignità significa affermare di fatto che la dignità è un attributo ontologico, una qualità intrinseca (e quindi inalienabile) dell’essere umano, al di là di differenze di sesso, di salute, di stato sociale. L’uso della nozione di persona come sinonimo delle qualità dell’adulto rischia di frantumare questo guadagno della politica. La biopolitica liberale rischia di essere fonte di discriminazioni tra gli uomini quando adotta un concetto di persona distinto da quello di essere umano. In essa rivive il dualismo antropologico proprio del platonismo. Le tesi di Hannah Arendt, di Eva Kittay e di Martha Nussabaum ci permettono di evidenziare i caratteri della persona umana sia come soggetto sia come essere corporeo diveniente nel tempo, secondo quell’intuizione che fu propria di Tommaso d’Aquino. Se si torna a pensare alla persona umana come essere umano diveniente nel tempo, è possibile salvaguardare i diritti di tutti e in particolare difendere quelle fasi della vita umana in cui la persona umana è esposta, per le fasi dello sviluppo o per la malattia, alla dipendenza. Solo così si può pensare ad una giustizia che includa tutti e tutte le fasi dell’esistenza, anche quelle segnate dalla disabilità. ---------- The United Nations Universal declaration of human rights (1948) has centred the assertion of human dignity and freedom as innate (not acquired) qualities in the logic of citizenship itself; this claim has been made not only in philosophical and religious terms, but also in political terms. Affirming that all men born free and equal for what concerns their dignity means to affirm actually that dignity is an ontological attribute, an intrinsic quality (and therefore inalienable) of the human being, beyond sex, health and social standing differences. The use of the notion of person as synonym of the qualities of adult risks to crush this gain of politics. The liberal biopolitics risks to be a source of discriminations among men when it adopts a concept of person different from that of human being. According to this view, the anthropological dualism peculiar to the Platonism lives again. Hannah Arendt, Evas Kittay and Martha Nussabaum’s thesis allow us to underline the human person characteristics as both subject and bodily being, according to the Thomas Aquinas’ intuition. If we think again human person as human being, it is possible to safeguard the everybody rights and particularly to defend those phases of human life in which human person is exposed, for the phases of the development or for the illness, to the dependence. Only in this way justice could be thought including all and all the phases of the existence, also those marked by disability.

For more than a decade, the Council of Europe has expressed deep concern over irregular migrants’ poor access to basic social rights. With this in mind, I consider the extent to which the European Convention on Human Rights can contribute to protect irregular migrants in the social sphere. To this end, I consider the role of international supervisory bodies in social rights adjudication and discuss the suitability of international adjudication as a means to uphold irregular migrants’ social rights. Having reached the conclusion that international adjudication can help protect irregular migrants’ social rights, I examine the ‘social dimension’ of the European Convention on Human Rights and the significance that the European Court of Human Rights attaches to immigration status. I posit that the importance that the Court attaches to resource and immigration policy considerations in N v. United Kingdom significantly constrains the ability of the European Convention on Human Rights to afford irregular migrants protection in the social sphere.

In the article, within the framework of the general exploration of human rights was made an attempt to substantiate the importance of social rights as a separate category of rights that belongs to the «second generation» of human rights and needs analysis within the state and legal reality. Attention was paid to the historical aspect of the development of social rights. The events, that inevitably influenced the emergence, development and ideological justification of the need for recognition of social rights are analyzed, the causal links involved in their formation are also indicated. In publication the connection of social rights with the concept of the welfare state is revealed, the main purpose of this state is to promote the realization of these rights. The fundamental features of this form of organization of government and society make it possible to evaluate the great dependence of the realization of social rights on socially oriented policy and economy of the country. For a deep understanding of the essence and ideas embedded in the content of social rights, the features and characteristics of this category of rights are studied. Attention is also paid to the different approaches to the concept of social rights expressed by researchers in this issue. The sources in which social human rights are legally fixed are considered (the Universal Declaration of Human Rights, the European Social Charter, the Constitution of Ukraine, the German Social Code). Also there is a comparative analysis of the enshrinement of these rights in courses mentioned above. Particular attention is paid to the characteristics of social rights listed in the German Social Code, as well as to the content of the agreement between Ukraine and Germany about cooperation in the social sphere. Great attention in the publication is paid to the studying of events in Ukraine that hinder the realization of social rights. The coronavirus pandemic and military events in the East of the country have negative impact on the implementation of social rights. The statistical data confirming the violation of the housing rights and medical care at present are given. Conclusion is formulated about the need of analyzing social rights as a specialized group of human rights, which have passed a significant historical path of formation and have unique characteristics and features.

The social doctrine of the Catholic Church is an indication of the active involvement of the Church in disseminating the ideas ofthe welfare state and it reflects its attempts to establish ideals of the welfare state through an external influence on the ideology of countriesthat belong to Christendom.Furthermore, one cannot ignore the fact that encyclicals had a direct or indirect influence on the adoption of the first social protectionacts in Catholic Europe where encyclicals played an important role.As a result, the Holy See aligned itself with the labour movement.Considering the fact that papal encyclicals covered the entire Catholic World, these documents can be viewed as an example ofinternational soft law.The first social rights, principles, and values in the area of social protection were enshrined in the encyclicals.Social rights belong to second-generation human rights the legal basis for which comprises international instruments adoptedafter the Second World War (the Universal Declaration of Human Rights (1948), the Convention for the Protection of Human Rightsand Fundamental Freedoms (1950), the International Covenant on Economic, Social and Cultural Rights (1966), the European SocialCharter (Revised) (1965–1996), the European Code of Social Security (1964), meaning 50 years after these rights were enshrined inpapal encyclicals.There is an indisputable fact that has still not been discussed in scientific research on social protection and according to whichthe social doctrine of the Catholic Church can be viewed as an inherent part of the process of occurrence, formation, and developmentof social protection, and it can be regarded as an ideological framework, a source of social rights and principles of social protection.Considering the above-mentioned findings, the social doctrine of the Catholic Church can be defined as the body of legislationadopted by the Holy See regarding the status and development of social and labour rights, their place in a person’s life and in publiclife. Papal encyclicals form the basis of that legislation and they are addressed to believers, bishops, and archbishops.

Abstract Apropos the history of human rights in France, one spontaneously thinks of the French Revolution and then of left-wing activists, particularly socialists. Their opponents, the Catholics, normally considered to be right wing and usually opposed to socialism, appear as a counterpoint. This article argues that some Catholics, especially those who referred to themselves as ‘social Catholics’, also contributed to the adoption of certain rights, particularly social rights, in France in unexpected and paradoxical ways. Their contribution was made through their social activities, visible in their organizations’ archives more than through their discourse. Social Catholics spoke little of ‘rights’. Yet paradoxically, discourses about ‘duties’ can lead to the defence of rights, especially through the practice of social surveys and the importance of social ‘facts’. Examples are taken from the history of the Ligue Sociale d’Acheteurs, the Union Féminine Civique et Sociale and other French Catholic organizations such as the Secrétariats sociaux.
