In article discusses topical issues of implementation of the legal monitoring mechanism. The authors made an attempt to discover the essence of the legal monitoring mechanism, to analyze and to assess the sufficiency of those functions, that are reserved for judicial authorities in this mechanism, and also to pay attention to specificity of monitoring of procedural rules as a type of law enforcement monitoring. Reveals the theoretical basis of the legal and regulatory monitoring? The organization the legal monitoring software. The authors proposes creation of a complex program of legal monitoring and law-application as an instrument of improvement of quality of normative-law acts. In article ways of influence of judicial practice on lawmaking and practice are generalized and systematized. Specific proposals are formulated. It ensures the scientifically-reasonable approach to a choice of directions of legislative development and in the end — an internal coordination of the legal system as a whole.

In the information and digital environment, the transformation of the legal system is becoming topical and is being updated, including state authorities of all levels as well as the regulatory legal system, regulation-making, law enforcement and judicial practice, the powers of officials and subjects of legal relations in order to comply with such principles as openness, accessibility, legality, public control. In this regard, the transformation will first of all affect the specialists in the field of jurisprudence, whose competencies are being formatted at the intersection of information, digital and legal areas in the creation process of the updated legal system base. In this context, scientific and educational institutions of the highest level are assigned to implement a strategic task to update the new professions in the field of law at institutional level. The aim of the research work is to identify some relevance aspects of law education transformation. The problem of research work is linked with contradictions at the job market due to the low demand for former professions as well as the depreciation of the educational system because of the lack of technology in the development of educational and other alternative forms of education on platforms and profile platforms. The novelty of the research work is expressed by the practical application of the institutional approach to the implementation of professional standards in qualifications’ updating through network collaborative educational and project programmes. The conclusions of the research work are expressed in the concept of professional standards’ implementation; development of network collaborative educational programmes; module and project training as the main tools for legal professions’ modification.

Abstract: Agrarian conflictare inextricably linked to issues of injustice. There is a view that in equality in the agrarian conflicts can and should be resolved through legal measures, which were touted asthe establishmentand enforcement measures. By elaborating the idea of ​​access to justice within the framework of ROLAX and ROLGOM, as well as approach esthatare reviewed by the Theory access Ribot and Peluso, this paper seeks to study how access to justice can be achieve din agrarian conflicts. Of elaboration that access to justice can be the key to recovery in equalityin agrarian conflicts not only depend on the outcome of judicial decision simposing procedural-formal. The approach used is expected to read the constellation of the struggle for justice more broadly than just law enforcement measures and the establishment of formal, ie starting from the flow of benefits as well as the power relations that underliean access, to the quality of the legal system and achieving justice process based on the rule of law. With the scope of the analytical framework and approach, this paper focuses on the theoretical and conceptual depth. However this paperal so gives an over view and attempta simple analysis of the struggle of the Moro-moro citizens Register 45 Mesuji Lampung as acasestudy of the acquisition of access to justicein agrarian conflicts. Abstrak. Ada pandangan bahwa ketidakadilan dalam konflik agraria dapat diselesaikan melalui langkah yuridis sebagai langkah pembentukan dan penegakan hukum. Dengan mengelaborasi gagasan akses terhadap keadilan dalam kerangka Rolax dan Rolgom, serta pendekatan Teori Akses yang ditelaah oleh Ribot dan Peluso, tulisan ini berupaya untuk mempelajari bagaimana akses terhadap keadilan dapat dicapai dalam konflik agraria. Pendekatan yang digunakan diharapkan mampu membaca konstelasi perjuangan akan keadilan secara lebih luas daripada sekadar langkah pembentukan dan penegakan hukum formal, yaitu mulai dari adanya aliran manfaat serta relasi kekuasaan yang  mendasari sebuah akses, sampai kualitas perangkat dan sistem hukum dari prosesmenggapai keadilan berdasarkan prinsip negara hukum. Abstract: This study discusses the history of fatwas on Muslim-Non-Muslim relations issued by the Bahthul Masa'il Institute (LBM) of Nahdlatul Ulama from 1926 to 2019. This research is a type of qualitative research focused on studying LBM written materials. The perspective used is the Study of Religion with a theoretical analysis from Joachim Wach regarding the forms of expression of religious experience, especially in the sociological form. This study finds that, historically, NU issued fatwas by considering such sociological aspects that taghayyur (law change) method is used in law enforcement. By adhering to this principle, NU has formulated fatwas to maintain Muslim-non-Muslim relations under the umbrella of the Unitary State of the Republic of Indonesia. In this regard, NU argues that non-Muslims in Indonesia cannot be categorized in terms of the infidel in the nation-state because non-Muslim citizens in the nation-state context are not second-class citizens as contained in the concept of infidel with various types. The implication is the increasing quality of inter-religious relations that are increasingly harmonious in a plural society.الملخص :تناقش هذه الدراسة تاريخ الفتاوى حول العلاقات بين المسلمين وغير المسلمين الصادرة عن معهد بهتول المسائل (LBM)  لتابع لنهضة العلماء من عام  1926 إلى عام  2019. هذا البحث هو نوع من البحث النوعي الذي يركز على دراسة المواد المكتوبة من قبل  LBM. المنظور المستخدم هو دراسة الدين مع تحليل نظري من Joachim Wachفيما يتعلق بأشكال التعبير عن التجربة الدينية ، وخاصة في الشكل الاجتماعي. توصلت هذه الدراسة إلى أنه تاريخياً ، أصدرت جامعة النيل فتاوى من خلال النظر في الجوانب الاجتماعية ، وبالتالي استخدام طريقة التغايور )تغيير القانون  (في إنفاذ القانون. بالالتزام بهذا المبدأ ، قامت NU بصياغة فتاوى للحفاظ على العلاقات بين المسلمين وغير المسلمين تحت مظلة الدولة الموحدة لجمهورية إندونيسيا. في هذا الصدد ، يجادل NU بأنه لا يمكن تصنيف غير المسلمين في إندونيسيا من حيث الكفار في الدولة القومية لأن المواطنين غير المسلمين في سياق الدولة القومية ليسوا مواطنين من الدرجة الثانية كما هو وارد في مفهوم الكفر. بأنواع مختلفة. المعنى الضمني هو الجودة المتزايدة للعلاقات بين الأديان التي تزداد انسجامًا في مجتمع تعددي.Abstrak: Penelitian ini membahas riwayat fatwa hubungan Muslim-Non-Muslim yang dikeluarkan oleh Lembaga Bahthul Masa'il (LBM) Nahdlatul Ulama dari tahun 1926 hingga 2019. Penelitian ini merupakan jenis penelitian kualitatif yang difokuskan untuk mengkaji bahan tertulis LBM. Perspektif yang digunakan adalah kajian agama dengan analisis teori dari Joachim Wach mengenai bentuk-bentuk ekspresi pengalaman beragama, terutama dalam bentuk sosiologis. Studi ini menemukan bahwa dalam sejarahnya, NU mengeluarkan fatwa dengan mempertimbangkan aspek sosiologis, sehingga memakai metode taghayyur (perubahan hukum) dalam penegakan hukum. Dengan berpegang pada prinsip ini, NU telah merumuskan fatwa-fatwa untuk menjaga hubungan Muslim-non-Muslim di bawah payung Negara Kesatuan Republik Indonesia. Dalam kaitan ini, NU berpendapat bahwa non-Muslim di Indonesia tidak dapat dikategorikan dalam istilah kafir dalam negara-bangsa karena warga negara non-Muslim dalam konteks negara-bangsa bukanlah warga kelas dua sebagaimana termuat dalam konsep kafir dengan berbagai jenisnya. Implikasinya adalah meningkatnya kualitas hubungan antar umat beragama yang semakin harmonis di masyarakat plural.

Introduction. The history of the formation and development of forensic examination as an independent type of criminal procedural activity is long and very ambiguous. The patterns of its occurrence and stages of development predetermine the importance of expertology for modern law enforcement practice. The emergence and active use of new branches of scientific knowledge determine their introduction and influence on criminal proceedings, which is clearly demonstrated by the example of psychology. Theoretical Basis. Methods. The theoretical basis of the work is the scientific developments of domestic and foreign researchers devoted to the study of the possibilities and problems of using special psychological knowledge in assessing the reliability of testimony obtained in the course of pre-trial and judicial proceedings in a criminal case. Research methods – systemic, historical, logical, comparative and hermeneutic. Results. Without psychological and pedagogical special knowledge, it is impossible to imagine modern proceedings in the vast majority of criminal cases involving minors. The article provides a retrospective analysis of the application of non-legal knowledge to reveal lies in the testimony of witnesses, systematizes the experience of modern Russian law enforcement investigative and judicial practice, examines the arguments given in scientific sources and court decisions on the use of special psychological knowledge to substantiate and assess the reliability of the testimony of participants in criminal proceedings.The work examines the current capabilities of psychology and their potential for proving in the course of criminal proceedings, cites the positions of scientists who previously studied the studied complex of material and procedural problems. Discussion and Conclusion. On the basis of the available empirical experience, the author’s conclusion is formulated about the advisability of practical use in the process of proving psychological research of a teacher-psychologist aimed at identifying psychological signs of the reliability and/or unreliability of information reported by participants in criminal proceedings, especially in the process of forming a sequence and in the course of proving, formulating investigative versions, as well as in order to substantiate the conclusions of the investigator and the court with the testimony of an expert, a specialist who conducted the corresponding study. In connection with the identified problems, the necessity of preparing explanations at the departmental level of the significance and procedure for using special psychological knowledge in criminal proceedings is substantiated.

The orientation of Indonesian democracy is the establishment of an Indonesian rule of law based on Pancasila. The disorientation of Indonesian Democracy caused the unstable political situation, uncontrolled freedom of press, uneven law enforcement. This situation has resulted in the low quality of democratic implementation in Indonesia compared to ASEAN countries. This research uses a normative juridical method with qualitative. The theory of “law is the spirit of the volk” which pioneered by von Savigny and the theory of legal system by Friedman will be the theoretical analysis in this research. Based on theory law is the spirit of the volk by Savigny, the current Indonesian state administration is not in accordance with the culture and history of the Indonesian nation. The cause of disorientation of democracy in Indonesia, first, the existence of cultural degradation of society. Second, the destruction of the legal and political system. Third, uncontrolled freedom of press. Pancasila as the volkgeist (spirit of the nation) of Indonesia should be the basic of state administration. Based on the legal system theory, the revitalization of Pancasila’s values and the legal culture education is the solution to resolve disorientation of Indonesian democracy.

Some problems of the practical implementation of the institution of judicial penalty in Russian civil proceeding are analyzed.

This article aims to explain maqâṣid al-Qur’ân according to M. Quraish Shihab and its application in interpreting verses related to the use of social media. The problem that will be answered in this article covers two main issues, namely how the perspective of maqâṣid al-Qur’ân according to M. Quraish Shihab and how it is applied in interpreting the verses of the use of social media. The method used is the thematic method, namely discussing verses based on themes. Fr om this study the authors concluded that according to M. Quraish Shihab there are six elements of a large group of universal goals of the al-Qur’ân, namely strengthening the faith, humans as caliphs, unifying books, law enforcement, callers to the ummah of wasathan, and mastering world civilization. The quality of information lies in the strength of the monotheistic dimension which is the highest peak of the Qur’anic maqâṣid. M. Quraish Shihab offers six diction which can be done by recipients of information in interacting on social media. Thus, it aims to usher in the knowledge and understanding of what is conveyed in carrying out human mission as caliph, enlightenment through oral and written, law enforcement, unifying mankind and the universe to the ummah of wasathan, and mastery of world civilization

Cash waqf in Indonesia has been long enough implemented based on some rules enacted by government and other rules defined by The Waqf Board of Indonesia (BWI). However, the implementation of cash waqf has not reached the level of success. Therefore, this article studies the application of cash waqf law in Indonesia according to Friedman’s legal system theory. The legal system theory of Friedman firstly looks at the substance of the law, which is the rules or regulations; and secondly it examines the structure of the law, encompassing the law enforcement agencies, such as judge, prosecutor, police and legal counselors. And lastly the theory examines the element of legal culture, which is a response from Muslim society. The first two examinations indicate that there is nothing to be a problem. But from the last examination there is a problem regarding the trust from Muslim society. From the legal culture point of view, the implementation of cash waqf by the government, which is performed by BWI, needs attracting society’s credentials in order to improve and maximize the performance of cash waqf in Indonesia.

Investigating, deterring and imposing legal sanctions on cyber-criminals warrants an international legal framework for the investigation and prosecution of cybercrime. The real-world limits of local, state and national sovereignty and jurisdiction cannot be ignored by law-enforcement officials. It can be a strenuous task to obtain information from foreign countries, especially on an expedited basis – more specifically when the other country is in a different time zone, has a different legal system, does not have trained experts and uses different languages. In South Africa existing laws appear to be inadequate for policing the cyber realm. The effects and impact of information technology on the legal system have not yet received the attention they warrant. The challenges presented by the electronic realm cannot be solved merely by imposing existing criminal and criminal procedural laws which govern the physical world on cyberspace. The electronic realm does not necessarily demand new laws, but it does require that criminal actions be conceptualised differently and not from a purely traditional perspective. Sovereignty and the principle of non-interference in the domestic affairs of another state are fundamental principles grounding the relations between states; they constitute an important mechanism in the armoury of criminals. The harmonisation and enactment of adequate and appropriate transborder coercive procedural measures consequently play a pivotal role in facilitating effective international cooperation. This article examines the efficacy of South African laws in dealing with the challenges presented by police powers to search for and seize evidence in cyber environments. It analyses the rudimentary powers that exist in South African criminal procedure regarding the search for and seizure of evidence in cyber environments, and compares them against the backdrop of the more systemic and integrated approach proposed by the Cybercrime Convention.
