The American criminal justice system regarding sex is not just logically incoherent, it is also often morally bankrupt because it remains unexamined and poorly understood. This Article contends that there are actually common roots underlying the seemingly oppositional forces of social panic and denial, which explain why the United States has an endemic sexual violence problem. Both panic and denial reinforce the implicit, and sometimes explicit, desire to avoid substantive engagement with socially contentious issues related to sex. The use of residency restrictions and civil commitment fit the modern social goal of putting sex offenders out-of-sight and out-of-mind. Yet, those same desires also explain America’s unwillingness to believe victims of sexual violence and police failure to properly investigate criminal complaints. In this way, sex panic dovetails with sex denial—in both instances, American culture only permits a limited discussion and understanding of sex and sexual violence. The result is that our nation fails to take sex crime complaints seriously while overreacting to the few convictions that emerge from the hostile criminal justice system.

Objectives. To report trends in sexual violence (SV) emergency department (ED) visits in the United States. Methods. We analyzed monthly changes in SV rates (per 100 000 ED visits) from January 2017 to December 2019 using Centers for Disease Control and Prevention’s National Syndromic Surveillance Program data. We stratified the data by sex and age groups. Results. There were 196 948 SV-related ED visits from January 2017 to December 2019. Females had higher rates of SV-related ED visits than males. Across the entire time period, females aged 50 to 59 years showed the highest increase (57.33%) in SV-related ED visits, when stratified by sex and age group. In all strata examined, SV-related ED visits displayed positive trends from January 2017 to December 2019; 10 out of the 24 observed positive trends were statistically significant increases. We also observed seasonal trends with spikes in SV-related ED visits during warmer months and declines during colder months, particularly in ages 0 to 9 years and 10 to 19 years. Conclusions. We identified several significant increases in SV-related ED visits from January 2017 to December 2019. Syndromic surveillance offers near-real-time surveillance of ED visits and can aid in the prevention of SV.

Assessing the Victimizaton-Offending Hypothesis of Sexual and Non-Sexual Violence in a Nationally Representative Sample of Incarcerated Men in the United States: Implications for Trauma-Informed Practice in Correctional Settings

Rates of exposure to sexual and non-sexual physical violence and other adverse childhood events are greater among people who are incarcerated with convictions for offenses related to sexual and non-sexual violence compared to other incarcerated populations and the general community. Few studies have differentiated which types of prior adverse experiences are greatest predictors of sexual and non-sexual violent offenses. The following study investigated associations between experiencing sexual abuse as a child or adult; experiencing non-sexual physical violence during childhood, adulthood, or both; having a caretaker who uses drugs; being in foster care; growing up in socioeconomically marginalized conditions; and the likelihood of reporting a prior physical or sexual conviction. The sample consisted of 13,604 men incarcerated in state and federal prisons in the United States. Multinomial regression models compared convictions for sexual offenses and non-sexual violent offenses to all other crimes. A model also compared sexual offenses to non-sexual violent offenses to differentiate between types of adverse childhood experiences associated with sexual versus non-sexual violent offending. Models adjusted for race/ethnicity, education, and age. Results suggest that exposure to violence during childhood was significantly and violence during adulthood was insignificantly associated with increased risk of conviction for a non-sexual physical offense. Sexual violence victimization as a child only was associated with increased risk of conviction for sexual violence perpetration during adulthood. Foster care involvement was associated with increased risk of being convicted for a non-sexual violent offense. Findings suggest that different traumatic pathways may differentiate types of aggression in adulthood. Future research must evaluate if trauma-informed approaches should be catered to address the unique effects of sexual and non-sexual victimization and the perpetration of different types of aggression in adulthood.
