Fledføring – elder care and the protection of the interests of heirs in Danish medieval laws

AbstractThe Danish fledføring is a legal term referring to an institution which combined assistance to persons who, because of old age, illness or otherwise, were no longer able to provide for their own support, and the protection of their heirs' interests. During formal proceedings before the local court, the person in need would offer himself and all his property to his heirs, who would in return offer him food and shelter. The institution did not only entail material consequences regarding the property and the duty of maintenance, it also affected the legal status of the fledførte person, who lost all his personal rights and was placed under the guardianship of his heirs. Traditionally, the fledføring has been presented as an ancient form of care for the elderly. That view, however, should be questioned, for, arguably, the institution was more concerned about determining who was entitled in law to land and other property than about the care of those in need.

These comments on Hendrik Hartog's Someday All This Will Be Yours: A History of Inheritance and Old Age (2012) examine the delivery of elder care in the nineteenth and early twentieth centuries and the resonance with care practices today. The book's stories of how older people arranged for their care transcend time and place, showing the age‐old difficulties of providing care for the elderly.

This article aims to provide a practical overview concentrating on civil legal aspects of psychiatric care for the elderly. We limit ourselves to English law (which also has jurisdiction in Wales; Scottish and Northern Irish law may be similar, but not identical). Civil law can, in turn, be divided into statute law (legislation provided by Parliament) and common law (the UK, unlike some European countries, has a strong tradition of law based on previous rulings by judges).

Currently, the questions of how older people fit into the context of modern reality, to what extent their inherent life ideas are consistent with existing social norms are becoming relevant. The history of the development of attitudes towards the elderly, the position of old people is constantly changing. It is known that the life of old people largely depends on their social status in society. The article presents the results of studying the attitude of young people and people of mature age in Yakutia to old age and readiness to care for the elderly. The study involved representatives of young and mature age in the amount of 222, including 109 men, 113 women. 142 (64%) respondents live in cities, 80 (36%) - in rural areas. 68 (31%) of the respondents have higher education, the rest - secondary, 85.3% of the respondents are of mature age and 14.7% of young people live with their parents. The analysis of ethnographic works, folklore materials was used as research methods; survey method. The reliability of the difference in indicators was checked using the angular Fisher transformation. Analysis of the research results allows us to note that respondents treat elderly people with patience and care, however, young people tend to be indifferent to aging parents. The attitude towards the placement of parents in nursing homes is also noticeably different: young people are ready to place their parents in nursing homes if the circumstances are difficult. Comparison was also made of the opinions of representatives of different nationalities about their attitude to old age, and their willingness to care for elderly parents, it found that they also differ. Comparison of the research indicators showed that there is a high connection with the family among representatives of the small peoples of the north, they are also more re- sponsible for their parents, although in other nations, the readiness to care for the elderly is high among the Yakuts (p <0.05). In the future, the study of attitudes towards old age will be relevant, since the aging of the population is observed throughout the world.

AbstractThis article describes the position of elderly people from the perspective of money anddiscusses the meaning of money from the perspective of elderly people. Anthropological research was carried out in 1994, 1995 and 1996 in a rural Kwahu community in southern Ghana. It consisted mainly of long conversations with elderly people and their relatives. Money is a core symbol in daily life by which people measure the value of their relationships. It is not used to keep people at bay but rather to establish and maintain social bonds and to secure care in old age. Having money engenders respect, as it is a sign of a successful life, while lack of money discloses failure and shame. Giving money is a way of ‘paying’ respect and shows affection and care for the elderly.
