AbstractThe Southern Bluefin Tuna (Jurisdiction and Admissihilily) Award of 4 August 2000 marked the first instance of the application of compulsory arbitration under Part XV, Section 2 of the 1982 UN Law of the Sea Convention and of the exercise by the Annex VII Tribunal of la compétence de la compétence pursuant to Article 288(4) over the merits of the instant dispute. The 72-paragraph Award is a decision of pronounced procedural complexity and significant multifaceted impacts of which appreciation requires an in-depth acquaintance with procedural issues of peaceful settlement of disputes in general and the-law-of-the-sea-related disputes in particular. Therefore, the article surveys first the establishment of and the course of proceedings before the five-member Annex VII Arbitral Tribunal, presided over by the immediate former ICJ President, Judge Stephen M. Schwebel, and also comprising Judges Keith, Yamada. Feliciano and Tresselt. Subsequently, the wide range of specific paramount questions and answers of the Tribunal are scrutinised against the background of arguments advanced by the applicants (Australia and New Zealand) and the respondent (Japan) during both written and oral pleadings, including in reliance on the extensive ICJ jurisprudence and treaty practice concerned. On this basis, the article turns to an appraisal of the impacts of the Arbitral Tribunal's paramount holdings and its resultant dismissal of jurisdiction with the scrupulous regard for the fundamental principle of consensuality. Amongst such direct impacts as between the parties to the instant case, the inducements provided by the Award to reach a successful settlement in the future are of particular importance. The Award's indirect impacts concern exposition of the paramount doctrine of parallelism between the umbrella UN Convention and many compatible (fisheries, environmental and other) treaties, as well as of multifaceted, both substantial and procedural effects of that parallelism. All those contributions will importantly guide other courts and tribunals seised in the future under the Convention's Part XV, Section 2.

A particularly dangerous and now common type of spam known as "Phishing” attempts to trick recipients into revealing personal and sensitive data, such as passwords, login ID’s, financial information or social security numbers. Recipients are directed to counterfeit and fraudulent websites that are exact duplicates of well-known and respected companies such as eBay, PayPal or large banking institutions and prompted to enter account information. This white paper addresses current issues associated with phishing scams and argues the most probable and likely direction phishing scams will follow in the future. Recommended safe user guidelines are included to help protect users from both current and future phishing attacks.

Bruce Gentry, the editor of Flannery O’Connor Review, reflects on the state of O’Connor studies. He shares the story of why and how the National Endowment for the Humanities Institutes on O’Connor came about, reviews a few of the struggles and successes, and shares a few thoughts about the future of O’Connor scholarship. He argues that while he no longer thinks we will ever fully figure out O’Connor as a Catholic writer, he believes O’Connor wanted to be taken seriously, first and foremost, as a writer, and, therefore, he has defined his mission as working to expand O’Connor studies beyond the southern and beyond the Catholic. He then discusses O’Connor’s broad appeal in disciplines beyond English. He celebrates the increasing diversity in approaches to her work and anticipates that the trend will continue as we find new answers to old questions and answers to brand new questions too.

The abundance of the worldwide resources of natural gas and its qualities as a “clean” fuel make it a major energy option for the future. However, the increasing distance of resources in relation to the major consuming zones should bring about a considerable development of international gas trade and also a very substantial rise in the cost of future supplies to major markets. Will these markets accept a new scale of value for natural gas in relation to other fossil fuels in order to ensure the economic viability of the formidable investments required in the coming decades is the most critical question of the gas industry, among many other technical, economic and political issues.

ZusammenfassungDie soziale Sicherung der Frau umfaßt geschlechterspezifisch bedeutsame Regelungen in Alterssicherung, Kranken- und Pflegeversicherung sowie Sozialhilfe. Es werden Entwicklungen der Hauptanknüpfungstatbestände der sozialen Sicherung - „eigene Erwerbstätigkeit“ und „Familie“ - sowie die bestehenden Regelungen der Alters- und Krankenversicherung und deren weitere Entwicklungsoptionen dargestellt: Von Kohorte zu Kohorte kann man in der Bundesrepublik Deutschland eine zunehmende Bedeutung der eigenen Erwerbstätigkeit für die soziale Sicherung beobachten. Die Familie bleibt dessen ungeachtet heute und künftig für die soziale Sicherung unverzichtbar. Für die ab etwa 1940 geborenen Frauen überwiegt die eigene Erwerbstätigkeit als Sicherungsgrundlage. Künftig muß eine adäquate Weiterentwicklung der Verzahnung eigener und abgeleiteter Sicherung erfolgen.

This chapter discusses intangibles not transferable by reason of public policy. In the case of certain sums receivable in the future, reasons of public policy preclude their assignment. The cases in this area tend to have a Dickensian feel to them—such as the rule that no effectual assignment can be made of the salaries or pensions of public officers payable to them for the purpose of keeping the dignity of their office or to ensure the due discharge of their duties—but the same sort of policy underlies the current statutory prohibitions on the assignment of social security benefits and pay in respect of a person's service in Her Majesty's military forces.
