Digital Forensic Investigations is explained as are sponse to an event that has already occurred in relation to information which is highly classified or is of prime importance to a criminal incident. Forensics Challenges in IoT Environments IoT would soon pervade all aspects of our life from managing our home temperature to thinking cars and smart management of the cities. The application of professional engineering principles and methodologies to investigating failures and incidents, usually to determine causation. Normally, it involves preparing a report of findings, which may form the basis for testimony in legal proceedings as an expert witness. A forensic engineer may serve as an engineering consultant to members of the legal profession and as an expert witness in courts of law, arbitration proceedings and administrative adjudication proceedings. Forensic engineering is a part of professional engineering practice that may cover all disciplines of engineering. It is a specialized set of skills that can include multidisciplinary training in failure analysis, simulation, safety, accelerated life testing and statistical analysis, as well as knowledge of the specific engineering field.

An expert’s integrity is vital for the success of a legal case in a court of law; and witness experts are very likely to be challenged by many detailed technical questions. To deal with those challenges appropriately, experts need to acquire in-depth knowledge and experience of the tools they work with. This chapter proposes an experimental framework that helps digital forensic experts to compare sets of digital forensic tools of similar functionality based on specific outcomes. The results can be used by an expert witness to justify the choice of tools and experimental settings, calculate the testing cost in advance, and be assured of obtaining results of good quality. Two case studies are provided to demonstrate the use of our framework.

Currently, expert witness's activities became an essential part of the development of business activities. Expert witness's activities deals with the process of determining the value based on the use of appropriate valuation methods. The basic role of expert witness's activities is valuation of the assets. In practice, expert witness' opinions are increasingly required not only by the courts and other public authorities, but also by the banking institutions, natural and legal persons. This demand stems primarily from the difference between the perception of price and the actual value of assets. The essential prerequisite for the success of a forensic expert witness's work is the access to quality information. The article's aim is to identify the information sources from which an expert witness is based on the preparation of expert witness's opinion. The theoretical and empirical research was applied in order to achieve the article's aim. The collection of empirical data was carried out using the technique of standardized interview with respondents. Based on the conducted research it can be concluded that the accounting is the principal point and the information source underlying the activity of a forensic expert witness in the determination of general asset value respectively the parts or individual assets items. Accounting presents the information source for various internal and external users. Forensic expert witnesses shall be even included to the users of accounting as regards the establishment of expertizing as a new scientific discipline.

Abstract Physicians who use the AMA Guides to the Evaluation of Permanent Impairment (AMA Guides) often serve as medical expert witnesses. In workers’ compensation cases, the expert may appear in front of a judge or hearing officer; in personal injury and other cases, the physician may testify by deposition or in court before a judge with or without a jury. This article discusses why medical expert witnesses are needed, what they do, and how they can help or hurt a case. Whether it is rendered by a judge or jury, the final opinions rely on laypersons’ understanding of medical issues. Medical expert testimony extracts from the intricacies of the medical literature those facts the trier of fact needs to understand; highlights the medical facts pertinent to decision making; and explains both these in terms that are understandable to a layperson, thereby enabling the judge or jury to render well-informed opinions. For expert witnesses, communication is everything, including nonverbal communication that critically determines if judges and, particularly, jurors believe a witness. To these ends, an expert medical witnesses should know the case; be objective; be a good teacher; state opinions clearly; testify with appropriate professional demeanor; communicate well, both verbally and nonverbally; in verbal communications, explain medical terms and procedures so listeners can understand the case; and avoid medical jargon, finding fault or blaming, becoming argumentative, or appearing arrogant.
