On March 5, 1970, the Treaty on the Nonproliferation of Nuclear Weapons (NPT) went into effect, having been ratified by 47 states including the Union of Soviet Socialist Republics, the United Kingdom, and the United States. The treaty legally bars these three nuclear powers from transferring atomic weapons to nonnuclear states and formally pledges those nonnuclear states signing the treaty to refrain from developing such weapons or acquiring them from other powers. It thus caps a long effort by the United States to inhibit—so long as it could not preclude—the spread of nuclear weapons and to avoid the potential instabilities associated with that spread.

In the course of a long and highly distinguished life, Lord Sherfield served in the Foreign Office, becoming Ambassador in Washington, was Joint Permanent Secretary of the Treasury, Chairman of the United Kingdom Atomic Energy Authority, Chancellor of the University of Reading, and held many other posts in the public and private sectors. In 1945, when Minister at the British Embassy in Washington, he took responsibility for advising on policy issues related to the nuclear weapons programme. Thereafter he was to remain an enthusiastic and most effective contributor to the advancement of science and technology.

The International Court of Justice recently gave judgment in Obligations Concerning Negotiations Relating to Cessation of the Nuclear Arms Race and to Nuclear Disarmament. The case concerned three parallel claims brought by the Marshall Islands against India, Pakistan and the United Kingdom for their alleged failure to fulfil obligations concerning negotiations relating to the cessation of the nuclear arms race and nuclear disarmament under art VI of the Non-Proliferation Treaty and customary international law. The Court in all three proceedings dismissed the claims at the preliminary objections phase on the sole ground that a legal dispute did not exist between the parties. In determining whether a legal dispute existed, the Court appears to have deviated from the objective determination taken in its previous jurisprudence by introducing, for the first time, a new requirement of "awareness". The Court also failed to address the other preliminary objections brought by the United Kingdom such as the Monetary Gold principle, which appears to have been a more credible avenue for the Court to dismiss the case. The case illustrates the failure by the Court to yet again confront the issue of nuclear weapons.

The article draws up an assessment of the resources and instruments a new prime minister inherits on his or her first day in 10 Downing Street. It examines the growth in the functions that have fallen to successive prime ministers, as heads of government, over the seven decades since the end of the Second World War. It explains the very special and personal nuclear weapons responsibilities that belong to a prime minister. It touches, too, on the physical and mental strains that often afflict those who carry the office of prime minister. The article examines Jack Straw’s proposal that the United Kingdom prime minister and the collective Cabinet system over which he or she presides should be placed on a statutory basis by Parliament.
