Abstract This Article places the recent evolution of U.S. personal jurisdiction in comparative context. Comparativism helps illuminate and explain both the modest convergences and the more pervasive divergences. On the convergences side, the Supreme Court’s acknowledgment of transnational litigation and express invocation of European approaches to personal jurisdiction have helped move general jurisdiction away from the exorbitant “doing business” jurisdiction that seemed previously to be settled U.S. law. But persistent divergences tell the more interesting story. The Court’s refusal to deviate from its commitment to transient jurisdiction, its recent narrowing of specific jurisdiction since 2011, its implicit rejection of pendent-party personal jurisdiction, and its adherence to a strong form of consent-based personal jurisdiction all reveal a stark contrast with other countries’ approaches to personal jurisdiction. That contrast is founded on deep and stubborn ties to American history, political structure, and litigation norms, all of which make broader convergence difficult, if not implausible. For these reasons, U.S. personal-jurisdiction doctrine is more likely to continue to develop on an independent track rather than hew to global trends. Some areas of parallelism might still occur, but substantial convergence is likely to remain elusive.

The article analyzes consumer`s dispositions in the food market of Ukraine in 2016-2019. Attention is paid to inflation and devaluation factors, which caused changes in the consumer sentiment of Ukrainians and reflected primarily in the food market and activity of retailers of food products. The behaviors of the main players of grocery retail, change of ratings of their success, features of geographical expansion towards the regions of Western Ukraine are investigated. It is concluded that local operators will develop within their regions, not significantly extending into the territory of adjacent areas, national retail food chains will develop by opening stores or seeking to absorb small ones. It is recommended that the domestic grocery retailer take into account the global growing trend – market consolidation, which allows players to increase their share, strengthen their position in the market and offer a more interesting price at the expense of economies of scale. It is noted that the grocery retail market in Ukraine is undergoing significant transformations today – both under the influence of global trends and under the influence of local consumption characteristics, consumer sentiment. The key trends affecting consumer sentiment and determining market development and doing business in the field of food retail in Ukraine are identified. It is concluded that consumer activity in the retail sector in the food market is gradually recovering. The most significant features that characterize consumer sentiment in the near term are identified: increase in consumer demands for product quality; resumption of the tendency to increase consumption of imported goods; an increase in the average check due to the number of items purchased; growing demand for quality service, unique consumer experiences and atmosphere, new impressions when shopping; reducing the effectiveness of promotions and discounts as tools for consumer engagement.

This study investigates the impact of Ease of Doing Business on Inward FDI over the period from 2011 to 2015 across the globe. This study measures ease of doing business using starting a business, getting credit, registering property, paying taxes and enforcing contracts. The research used a sample of 177 countries from 190 countries listed in World Bank. Least square regression model via E-views software used to examine causal relationship. The study found that ease of doing business indicators ‘Enforcing Contracts’ was found to have a positive significant impact on Inward FDI. Nevertheless, ‘Getting Credit’ and ‘Registering Property’ were found to have a negative significant impact on Inward FDI. However, ‘Starting a Business’ and ‘Paying Taxes’ have no significant impact on Inward FDI in the studied timeframe of this research. The findings of the study suggested the ease of doing business enables inward FDI through better contract enforcements, getting credit and registering property. The findings of the research will assist international managers and companies to know the importance of ease of doing business when investing in foreign countries through FDI.
