The article deals with the contemporary legal and ethical challenges, caused by coronavirus COVID-19. It analyses the reason why the western world was so much surprized by that pandemics. The text mentions the succeses of western medicine in the battle against epidemics in the 20th century and sees it as one of the reason for underestimating the public health issues in 21st century. The article also emphasizes on other contemporary threat, the antimicrobiotic resistance and the need for new legal answers to pandemics. It deals with problem of human genome editing as the central topic by creating of hereditary immunity against new viral threats. The text also mentions the risks of such new treatment and the impact on human dignity that is understood as leading value in the contemporary legal regulation on biotechnology.

Responsible Research and Innovation (RRI) is gaining momentum worldwide and is envisaged as a needed tool to properly govern controversial innovative technology (i.e. genome editing, AI). Europe is considered a leader in fostering such approach, notably through its institutionalization. Even so, the future of European Research and Innovation (R&I) seems to be designed without a central role for RRI. After long effort and so much public EU money to support projects to ground RRI principles and practices in key contexts for the flourishing of science and technology in Europe, such as the industrial realm and regional settings, this counter-intuitive decision could undermine the leadership of Europe in prioritizing civil and human rights and needs, values and expectations of its citizens when steering science and technology, that European R&I strongly need to go further.

AbstractThis article offers a critical assessment of the role of international human rights law in the regulation of genome editing. Given the rapid scientific developments in the field of genetics, it is important to explore the implications of the human rights framework for the research into and the clinical application of genome editing. The broader normative question is whether the existing human rights standards are sufficient to address the challenges posed by this new technology. It will be argued that while international human rights law does not prohibit genome editing, it imposes important restrictions upon it. However, existing human rights are arguably insufficient to regulate germline genome editing as there are significant loopholes in the protection of embryos. Nor do they fully address the wide-ranging implications of the new technology for society and humankind. It will be suggested that new standards are needed, ideally set out in a new international instrument and supported by an institutional framework, which address the specific challenges posed by this new technology.

The moon landing, now more than a half century in the past, has turned out to be the culmination of human space travel, rather than its beginning. Genetic engineering, especially applications of CRISPR, now presents the most publicly-discussed engineering challenges—and not just technical, but ethical as well. In this article, I will use the two most controversial genomic engineering applications to help identify the ethics and human rights implications of these research projects. Each of these techniques directly modifies the mechanisms of evolution, threatens to alter our views of ourselves as humans and our planet as our home, and presents novel informed consent and dual use challenges: human genome editing and gene drives in insects.I begin with a discussion of so far disastrously unsuccessful attempts to regulate germline editing in humans, including a summary of the first application of germline genome editing in humans and its aftermath. I then turn to a discussion of setting ethical standards for a genomic technology that has not yet been deployed in nature—gene drives. Finally, I end by suggesting that human rights can and should be directly applicable to defining the ethics of genomic research.
