The question as to whom should the authority to determine listing and delisting of species, populations, ecological communities and key threatening processes that affects the state's wildlife (flora and fauna) be delegated, for what purpose and what priority we should place them in relation to all of society's needs, is a fundamental and an important one. The authority for setting up the Scientific Committee of the Threatened Species Conservation Act (New South Wales) 1995 is examined. Its functions and the individuals that make up this Committee, who they represent and the determinations this Committee has reached so far are discussed. The implications for the listing of species, populations and ecological communities with some of the more serious problems such listings have caused are outlined with particular reference to the application of the 8-Point Test under s 5A of the Environmental Planning and Assessment Act 1979. These practical difficulties aside, the fundamental question still remains; Can the New South Wales State Parliament delegate its legislative powers for peace, welfare and good government, to a lower authority that is not directly elected by the people, accountable to no one and that has no propriety interest in the subject matter? Thus a question of Constitutional validity of all or part of the TSC Act arises.

Reproductive parameters of three closely-related sympatric species of wobbegong (Orectolobus ornatus, O. maculatus and O. halei) off New South Wales (NSW) were investigated to contribute to a biological basis for the management of a commercial fishery targeting wobbegongs. Estimates of the onset of maturity based on ovary condition were 729 mm, 1117 mm, and 1591 mm total length (TL) for O. ornatus, O. maculatus and O. halei respectively. The length at which 50% of the male population is mature based on clasper calcification was 803 mm, 1282 mm and 1784 mm TL for O. ornatus, O. maculatus and O. halei, respectively, and was similar to female onset of maturity based on uterus condition and to TL-at-maternity. These species of wobbegong had synchronous, triennial reproductive cycles. Follicles took 2 years to enlarge before ovulation. During the first year, follicles remained small, and then grew rapidly during the second year before ovulation during November. Gestation lasted ~10–11 months and parturition occurred during September–October. Mean litter sizes were nine (s.e. 0.5) and 21 (s.e. 1.5) for O. ornatus and O. maculatus, respectively, and increased with female total length in O. ornatus. Pregnant O. ornatus and O. maculatus were frequently caught in northern NSW and no pregnant wobbegongs, or females with large, yolky follicles were captured south of Sydney. Differences in the reproductive conditions of wobbegongs caught in northern and central NSW suggested geographically dependent reproductive behaviour. Knowledge of the reproductive parameters provided in this paper is necessary for adequate fisheries management and species conservation assessments.

Yellow-footed Rock-wallabies (YFRW) Petrogale xanthopus have declined in numbers since European settlement from past hunting for skins, habitat disturbance and predation and competition with feral animals (Gordon et al. 1978, 1993; Copley 1983; Henzell 1990). This has led to the species being classed as potentially vulnerable to extinction in Australia (Kennedy 1992), and endangered in New South Wales (Schedule 1, Threatened Species Conservation Act, 1995).

Sixty licensed kangaroo shooters were interviewed in New South Wales to determine their social characteristics, incomes and shooting preferences. Two groups of shooters were identified: those who take kangaroos only for immediate, maximum short term economic gain and those who attempt to husband local kangaroo populations to their long term benefit. Amongst the latter group there is both a lack of agreement and a general uncertainty about the optimal shooting strategy to achieve the long term economic benefits they desire. New directions in research and extension are suggested with a view to rectifying this dilemma. Data on the strategies used to take kangaroos for commercial purposes and the accuracy of certam information reported to the National Parks and Wildlife Service are also described.

A symposium on the dingo (Canis lupus dingo) was held in Sydney in May 1999 to discuss issues surrounding the conflicting views of the dingo: seen both as a potentially threatened species, and as a species that needs to be controlled because of its predation on livestock. The Symposium was particularly relevant to New South Wales (NSW) because of consideration being given to place the dingo on the schedule of NSW vulnerable species, under the NSW Threatened Species Conservation Act 1995. The potential for conflict was exacerbated by concurrent legislative changes in NSW (Rural Lands Protection Act 1998) requiring the Crown to control pest animals declared under the Act. Despite the obvious focus on the NSW situation, many of the issues discussed have wider relevance to the management and conservation of dingoes across Australia.
