Abstract: The MUI Fatwa about Female Circumcision. The issue of female circumcision has become a public issue following research, either independent or sponsored, repeatedly finding there to be a number of negative effects arising from allowing the enforcement of female circumcision in a number of countries. The issue of children’s and women’s protection are also often connected to the issue of the implementation of circumcision, especially in relation to children’s rights and women’s reproductive rights. This study finds that provisions targeting female circumcision do so in an effort to protect women’s rights. This article finds that the MUI fatwa, as well as ulamas’ views on madzhab and fiqh, which regulates procedures pertaining to the implementation of female circumcision, serves to strengthen the protection of children’s rights, that is, protection from negative effects which is caused by extreme actions in the dangerous practice of circumcision.Keywords: female circumcision, MUI, fatwa, fiqh, children’s protection.Abstrak: Fatwa MUI tentang Khitan Perempuan. Masalah khitan terhadap perempuan menjadi isu publik setelah adanya pelbagai penelitian, baik yang dilakukan secara independen maupun karena ada sponsor, yang menemukan adanya pelbagai dampak negatif yang ditimbulkan dari penyimpangan pelaksanaan khitan terhadap perempuan di beberapa negara. Isu perlindungan anak dan perempuan juga sering kali dikaitkan dalam masalah pelaksanaan khitan, khususnya terkait hak anak dan hak reproduksi perempuan. Studi ini menemukan bahwa ketentuan mengenai khitan perempuan sejalan dengan upaya perlindungan terhadap hak perempuan. Fatwa MUI, sebagaimana juga pandangan ulama mazhab fikih yang mengatur tata cara pelaksanaan khitan perempuan, justru meneguhkan perlindungan terhadap hak anak, yakni perlindungan dari dampak negatif yang ditimbulkan akibat tindakan berlebihan dalam praktik khitan yang menyebabkan bahaya.Kata Kunci: khitan, perempuan, fatwa MUI, fikih, perlindungan anakDOI: 10.15408/ajis.v12i1.964

<p>To talk about human rights in the new and modern format and is one of the most important features of the contemporary era and in which, the rights of women is of particular importance. Elimination of legal discrimination due to gender, in different aspects of the life of human rights, with emphasis on women's rights forms the primary focus of all regional and international treaties and Declaration of women's rights. Defending financial rights of women including women's inheritance right is a critical argument.</p>With a careful study, we find that in various religions, wife inheritance is accepted and in divine religions (with the holy book). This issue has been respected and regarding form, there are similarities between the religions about the wife inheritance, However, apart from similarities, regarding essence, they have legislative differences. So in this seminar, the wife inheritance in divine religions is explained and analyzed, and comparative review of wife and parents estate of deceased in different religions is done so the problems in this regard can be obviated.

This article is a first attempt to relate the UN Convention on the Rights of the Child to education policy. It compares three countries, Argentina, Chile and Spain in an attempt to both present particular problems that are of pressing concern in each and to propose a framework that might reveal some possible obstacles to the implementation of children's rights. The article is divided into three sections. In the first section, a comparative review of the formal dispositions and legislative changes in the three countries is presented. Some of the most notable contrasts are briefly contextualized in the history of each nation-state. In the second section, particular problems in each nation are reassessed through the lens of the Convention. Three cases are examined: in Argentina, the funding and organization of public compulsory education; in Chile, an instance of international cooperation in education; in Spain, the relations between public and private education and ethnic segregation. Finally, a general framework is discussed using these three cases as examples.
