Three recent books focused on law, gender, and Islam not only make important individual contributions to the field of law and religion, but together, in their attention to issues of gender, sex, violence, and law, signal an important development in both this field and the field of Islamic studies. This state of the field essay examines Kecia Ali's revised and expanded edition ofSexual Ethics and Islam, Ayesha Chaudhry'sDomestic Violence and the Islamic Tradition, and Hina Azam'sSexual Violation in Islamic Law. Individually and collectively, these works shed light on the way that societies use gender as a fundamental tool of social organization and hierarchy. While Ali, Chaudhry, and Azam focus mainly on the classical Sunni Islamic tradition, their insight has wider methodological import for the study of law and religion. Further, they illuminate the intellectual diversity within the Islamic tradition, both in the past and in the present. In doing so, they draw attention to the process of how the intellectual tradition is retrieved and appropriated in contemporary contexts. Finally, their work is historical and descriptive as well as normative: this kind of scholarship challenges the distinction in the study of religion between these two categories. Ali, Chaudhry, and Azam each places her observations and arguments about classical Sunni Islamic texts and traditions in productive conversation with ethical and legal questions that Muslims face today.

The influence of women in the establishment of Shariah law covering aspects of ability, qualifications, ability, determination,contribution and others which represent that women also played a role in the implementation of Islamic law. Shariah in its universal and flexible nature does not marginalize women in making or evaluating of the law. The objective of this paper is to discuss the influence of women in the establishment of Islamic law. The methodology used is based on the classical book of turath and contemporary Islamic studies covering fiqh, hadith and tafsir. The findings of the study show that women do have a role in the determination of Islamic law since in the past until the modern days.   Keywords: women, the influence of women, women and law, the determination of legislation.

Absent providers are a major problem both for public health facilities and primary schools in many developing countries. For example, in India, absence rates for teachers are over 24 percent, and for health providers they are over 40 percent. This paper presents evidence on a number of innovative strategies to reduce absenteeism in government– and nongovernmental organization–run schools and health facilities. These strategies were implemented in Kenya and India over the past few years and have been evaluated using the randomized evaluation methodology. The strategies involved alternative levers to fight absence. Some tried to improve incentives for providers, either through rewards and punishments implemented by external monitors, or through facilitating a more active involvement of those who expect to benefit from the service. Others are based on the idea that the providers are discouraged by the lack of interest among the potential beneficiaries in what they are being offered; these strategies aim at increasing the demand for the services as a way of putting more pressure on the providers. The results of these efforts, taken together, shed light not only on ways to address the problem of absence in the public sector, but also on the underlying reasons for this phenomenon.

This paper interrogates the notions of time and money in Islamic (economic) tradition by applying Toshihiko Izutsu’s theory of the key terms of a worldview. A Japanese scholar of Islam, Toshihiko Izutsu (1914–1993), wrote extensively on Islamic studies, eastern mystical traditions, and Sufism. His theory of key ethical concepts in the Qur’an is a semantic analysis of an Islamic worldview, which can be applied also more specifically to economic thought in Islamic tradition. Applying Izutsu’s theory would shed light on the main ethico-economic concepts and postulates in Islamic intellectual history, such as the notions of time, money, and commodity purchases, as well as their relation to man as a time-contingent being. As well as the introduction and conclusion, this paper is divided into three main parts. In the first part, I introduce Izutsu’s life and his semantic theory. The second focuses on Islamic economics and its relation to Sharī‘a as a moral concept, whereas the third part inquires more specifically upon the notion of time and money in classical and contemporary Islamic economic thought.

In this paper, I outline a propaedeutics of Islamic legal studies. I am using the term “propaedeutic” to refer to scholarship and pedagogy that introduces audiences to new material in a way that structures their curiosities and asks them to rethink commonplace familiar situations and assumptions. Those who teach about Islamic law in North American Islamic studies are working in an environment shaped by distinctive anxieties and preconceptions. Engaged scholarship informed by thinkers such as Wael Hallaq and Talal Asad seeks to disentangle conceptions of law from modern expectations of law enforcement, codification, and the supervisory neutrality of the state to consider other deliberations and practices of justice. Such propaedeutic scholarship should suggest how religious legal authority deals with more than just “spiritual” and “personal” matters. Imprecise introduction to the idea that Islamic legal opinion is non-binding can unintentionally imply that such opinion makes only moral suggestion that one chooses to follow or not. Scholarscritical of Max Weber’s judgment that Islamic jurisprudence amounts to little more than arbitrary invocations of authority should be careful not to present Islamic jurists as merely creatively “free” to be unsystematic and their decisions inconsequential if following them is not coerced. Drawing on the work of Hussein Agrama, I explore the idea of fatwa discernment as guiding counsel directed not at adversarial procedure but at ethical self-formation. Finally, I consider Saba Mahmood’s account of religious difference to suggest how Islamic legal traditions might complicate liberal ideas of jurisdiction.

The concept of “possession” is regarded as a fundamental principle in Islamic Law of Contract and it is discussed by jurists and Islamic scholars in their writings of fiqh in a very detailed manner. However, the way trade and business are operating in today’s modern world is very different from what was happening in the past. The globalization and industrialization has transformed the modes of trade & business and innovative forms are introduced which could not be imagined previously. This modernism and innovation has led to contemporary scholars to research and discuss these modern forms from Shariah viewpoint as they are not found explicity in old fiqh literature. The objective of this article is to discuss the concept of possessin and its modern forms taking into consideration the originat resources and the scattered literature of contemporary jurists.  In this regard, the paper has shed light on basic concepts of possession and its forms as well as the modern applications which are prevalent in the financial industry. It is found that the definition of “possession” is not defined in strict parameters by scholars but rather it has left to the “urf” and customary practices of people. Likewise, the paper concludes that the physical possession in not necessary but contructive possession is also considered legal and sufficient in Islamic law of Contract. Therefore, the modern forms of possession such bank draft, personal check, transfer in the account of creditor, payment with credit-card and bill of lading are also acceptable as they are considered as constructive possession.

This research concentrates on the actual religion surrounding the famed tomb-archeology of Sulawesi. This study, which focusses in particular on the Muslim religious leaders in Polewali Mandar, must first consider the first ancient tombs in Polman. In particular, we focus on the tomb at the Tangnga Island District of Binuang Polewali Mandar. Our selection of the tomb of Sheikh Bil Ma’ruf is motivated by that man’s key role and his remarkable persona given a society in which the veneration of tombs was central to people’s beliefs, and given that tomb archaeology can shed light on the sociology of a past society. It seems that the degree of veneration of a tomb corresponds to the honour in which a certain character’s memory is held. It seems that the veneration of Sheikh bil Ma’ruf’s tomb is directly proportional to the public celebration of this man’s deeds in his lifetime and the example that he gave to the flourishing local Islamic community in Sulawesi that came to be. Pemilihan objek makam sangat ditentukan oleh peran tokoh tersebut semasa hidupnya yang mempunyai peran keagamaan serta ketokohan kuat di tengah-tengah masyarakat. analisis sosial dilakukan untuk melihat lakon masyarakat terhadap makam. Hal ini sebagai pengejewantahan dari Archeology is sociology for the past. Hasil penelitian menunjukkan bahwa peranan tokoh yang dimakamkan berbanding lurus dengan perilaku masyarakat terhadap makam dengan melakukan lakuan-lakuan bernuansa keagamaan yang terangkum dalam hajatan-hajatan yang dilakukannya serta pola keberislaman masyarakat setempat. Penelitian ini mengkaji dakwah Majlis Tafsir Al-Qur’an di kota Kebumen. Majlis Tafsir Al-Qur’an beranggapan tradisi Islam tidak sesuai dengan tuntutan ajaran Al-Qur’an dan sunnah yang telah ditetapkan oleh Nabi. Saat ini gerakan Majlis Tafsir Al-Qur’an sudah berkembang hingga berbagai daerah-daerah di Indonesia, masyarakat memiliki dasar teologi dan ideologi yang kuat. Dakwah Majlis Tafsir Al-Aqur’an memberikan beberapa respon dari masyarakat. Masyarakat menolak dengan beberapa faktor seperti perbedaan ajaran perbedaan ideologi, dan budaya menjadi salah satu masalah dakwah Majlis Tafsir Al-Qur’an karena tidak sesuai dengan budaya masyarakat setempat, hingga memberikan perubahan ketidaknyamanan masyarakat karena telah terusik. Artikel ini mencoba untuk memperluas kajian islam tentang isu organisasi masyarakat berbasis agama Islam pada tiga Desa Kecamatan Adimulyo Kebumen. Kajian ini juga menggunakan beberapa konflik yang sama di daerah yang berbeda seperti Bojonegoro, Blora, Sragen, Gunungkidul, dan Purworejo. Majlis Tafsir Al-Qur’an sejak awal dakwah pengajian ini dianggap sesat oleh sebagian masyarakat, konflik yang terjadi antara masyarakat dan Majlis Tafsir Al-Qur’an tidak hanya pada ideologi saja tetapi juga menimbulkan kekerasan. Metode yang digunakan dalam penelitian ini adalah studi pustaka melalui media sosial, dan literature terkait. Penolakan yang terjadi merupakan segmen dakwah yang berbeda-beda dapat mendatangkan respon baik penolakan atau penerimaan dari masyarakat.Kata kunci: dakwah majlis tafsir al-qur’an, konflik, masyarakat beragamaThis study examines the da’wah of the Majlis Tafsir Al-Qur’an in the city of Kebumen. The Majlis Tafsir Al-Qur’an considers the Islamic tradition is not in accordance with the demands of the teachings of the Qur’an and the sunnah set by the Prophet. At present the Majlis Tafsir Al-Qur’an movement has developed to various regions in Indonesia, the community has a strong theology and ideology basis. Da’wah Majlis Tafsir Al-Aqur’an gives some responses from the public. The community refused with several factors such as differences in the teachings of ideological differences, and culture became one of the problems of preaching the Majlis Tafsir Al-Qur’an because it was not in accordance with the culture of the local community, so as to provide changes in community discomfort because it was disturbed. This article tries to expand Islamic studies on the issue of Islamic community-based organizations in three villages in the Adimulyo Kebumen sub-district. This study also uses some of the same conflicts in different areas such as Bojonegoro, Blora, Sragen, Gunungkidul, and Purworejo. Majlis Tafsir Al-Qur’an since the beginning of this preaching session is considered heretical by some people, the conflict that occurs between the community and the Majlis Tafsir Al-Qur’an is not only on ideology but also causes violence. The method used in this research is literature study through social media, and related literature. Rejection that occurs is a different da’wah segment can bring a response either rejection or acceptance from the community.Keywords: da’wah majlis tafsir al-quran, conflict, religious society

There has been a concern over a high unemployment rate among graduates of Islamic higher education and a low proportion of entrepreneurs in Indonesia. In fact, a high proportion of entrepreneurs is one of indicators of a country’s welfare. This has generated a question: to what extent do Islamic values cultivate entrepreneurial culture among its adherents? How to cultivate entrepreneurial culture in Islamic higher education? This paper will investigate this matter using a case study of Faculty of Islamic Law and Economics at Banten State Institute for Islamic Studies.  The paper argues that the curriculum at the faculty of Islamic Law and Economics has not been oriented towards building entrepreneurial culture. The curriculum consists of subjects to enhance the students’ competence and skills to prepare them as bachelors of syari`ah economics for the professions such as manager, lecturer, researcher, syari`ah auditor, etc, instead of preparing them for entrepreneurs who are capable to build his or her own business from the scratch.    To propose Islamic entrepreneurship study program at the FSEI of IAIN SMHB, it is important to have a strong political will not only from the internal IAIN but also higher authoritative body such as the Ministry of Religious Affairs to facilitate this from not only the accreditation process but also financial support. A further feasibility study needs to be undertaken to build its infrastructure such as qualified lecturers, appropriate curriculum structure, and recruitment student system. Since this field has a strong link with a ‘real sector’, there has been an urgent need to build cooperations with business sector to enable the students to undertake their apprentice and build their networks to facilitate their ability to develop their own business.     Keywords: Islam, entrepreneurship, entrepreneurial education.

This paper examines two young adult novels, Run Like Jäger (2008) and Summer of Fire (2009), by Canadian writer Karen Bass, which centre on the experiences of so-called ordinary German teenagers in World War II. Although guilt and perpetration are themes addressed in these books, their focus is primarily on the ways in which Germans suffered at the hands of the Allied forces. These books thus participate in the increasingly widespread but still controversial subject of the suffering of the perpetrators. Bringing work in childhood studies to bear on contemporary representations of German wartime suffering in the public sphere, I explore how Bass's novels, through the liminal figure of the adolescent, participate in a culture of self-victimisation that downplays guilt rather than more ethically contextualises suffering within guilt. These historical narratives are framed by contemporary narratives which centre on troubled teen protagonists who need the stories of the past for their own individualisation in the present. In their evacuation of crucial historical contexts, both Run Like Jäger and Summer of Fire support optimistic and gendered narratives of individualism that ultimately refuse complicated understandings of adolescent agency in the past or present.
